The Nigeria midfielder left Getafe for Palace at the end of the summer market, with former club Cueta counting on a percentage of any sale.
However, as Cueta president Luhay Hamido explained, the deal is an initial loan with the potential of a permanent transfer based on certain criteria being met.
Cueta are due 12.5 per cent of the agreed €19m fee, with Hamido further explaining on Club Deportivo: "Uche's money has not yet arrived, he has to play ten games as a starter for the purchase to count, if not, he returns to Getafe again.
"If he plays those ten games, the loan with the right to buy is mandatory and the corresponding percentage would be counted in chapter one of the salary cap.
"If it is before the winter market , we could use him."
